1. Limited Liability on Freight
Xprscargo's liability is limited per Article 22 of the Montreal Convention, the COGSA for ocean freight, and the CMR for overland transport, except where higher coverage is purchased via declared value insurance.
Claims must be filed in writing within 14 days of delivery (or estimated delivery for non-arrival) via our Claims Center.
2. Packaging Responsibilities
Shippers are responsible for ensuring cargo is packaged to withstand standard freight handling, vibration, and stacking loads typical of multimodal transport.
Dangerous goods must be packaged and labeled in accordance with IATA, IMDG, and ADR regulations as applicable to the chosen mode.
3. Payment & Late Fee Terms
Invoices are payable Net-15 from the date of issue unless otherwise agreed in writing. Late payments accrue interest at 1.5% per month or the maximum permitted by law.
Disputed invoices must be raised within 7 days of receipt; otherwise charges are deemed accepted.
4. Data Privacy
Xprscargo processes personal data in accordance with GDPR (EU), CCPA (California), Kenya's Data Protection Act 2019, and other applicable global frameworks.
Personal data is used solely to provide logistics services, comply with customs and trade-compliance obligations, and improve our platform. We do not sell personal data to third parties.
You may request access, correction, or deletion of your personal data at privacy@xprscargo.com.
5. Force Majeure
Xprscargo shall not be liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, port closures, armed conflict, or regulatory action.
6. Governing Law
These terms are governed by the laws of the Republic of Kenya. Disputes shall be resolved by binding arbitration under UNCITRAL rules, seated in Nairobi.
